The good news is that the IRS has temporarily suspended this tax liability for “forgiven” debt through the end of 2009; it may or may not be extended for 2010.”

David Smith recommends looking into other options including loan modification, refinancing the mortgage, or satisfying the debt with a short sale. After examining all these options, if one finds that none of these are workable, then it may be in their best interest to just walk away.
